A man in Zhambyl Region learned he had been dismissed from a notification, disputed his employer's decision and won back his job in court, the website infohub.kz reports.

According to the official Telegram channel of the Zhambyl Region courts, the Zhualy District Court heard a labor dispute between the man and a district hospital. Case materials show that the plaintiff had held the post of head of household services at the district central hospital since May 2024.

In February 2026, the employer issued an order terminating his employment contract by mutual agreement. The employee himself said he had not submitted a resignation letter, had not consented to the termination and wanted to keep working.

Disagreeing with the hospital's decision, the man first turned to a conciliation commission and then to court.

During the proceedings, the court established that in February 2026 the hospital sent the employee notice of its intention to terminate the employment contract by mutual agreement. In response, the plaintiff said he did not agree to the dismissal, did not want to lose his job and had no other source of income.

Under the Labor Code, mutual agreement is one of the grounds for terminating an employment contract, but it requires the employee and employer to reach a mutual understanding. The court concluded that the employer, without obtaining the employee's consent, had in effect terminated the employment relationship unilaterally, using a ground that presupposes the voluntary will of both parties.

The court ruled the dismissal order unlawful and annulled it, and the man was reinstated in his former post. In addition, the hospital was ordered to pay him 1.9 million tenge in wages and 200,000 tenge in compensation for moral harm. The ruling has entered into legal force.
