A court in Kazakhstan's Zhambyl Region has sided with a candidate for the post of school deputy director, ordering the school's management to review his job application. The news was reported by infohub.kz.

According to the official Telegram channel of the Zhambyl Region courts, the Turar Ryskulov District Court heard an administrative case brought by a citizen against the principal of a school-gymnasium. The plaintiff sought to have the defendant's inaction declared unlawful and to compel him to review the job application.

In March 2026, the school held a competition for the position of deputy director for educational work. Following the initial selection, the plaintiff was found to meet the qualification requirements. However, after an appeal by one of the competition's participants, the selection committee reviewed the candidates' assessment results.

After the documents were reconsidered, the plaintiff placed second. The winner of the competition subsequently declined the appointment voluntarily.

Despite this, instead of offering the position to the next candidate, the school announced that a new competition would have to be held. The plaintiff disagreed with that decision and went to court.

The court found that, under the Rules, if the winner of a competition declines the appointment, the position is offered to the next participant with the highest score. The Rules do not provide for holding a new competition solely because one of the participants filed a complaint.

The court concluded that the school principal's inaction had violated the plaintiff's rights.

The court upheld the administrative claim. The school principal's inaction was declared unlawful. The principal was ordered to review the plaintiff's job application.

The court awarded state duty to be recovered from the school in favor of the plaintiff. The ruling has entered into force.
