A resident of the Mangystau Region has won justice after six years: a court ruled that his removal from the housing queue, where he had been placed as an orphan, was unlawful. The news is reported by infohub.kz.
The man lost his parents at an early age and was raised in a regional orphanage from 2002 to 2013. On December 7, 2009, he was officially registered as a person in need of housing under the "orphans" category.
By early 2018, he held the 21st place in the queue. In 2020, however, officials at the Zhanaozen housing and utilities department removed him from the list, citing a change in his registered address.
The orphan went to court demanding that his original place in the queue be restored. During the proceedings, it emerged that the law prohibits removing such citizens from the register before they are provided with housing.
"When the plaintiff was removed from the register of those in need of housing in 2020, he belonged to the category of citizens who, under the requirements of the law, could not be removed from the register," the court explained.
The court upheld the claim and ordered the Zhanaozen housing and utilities department to restore the man to the queue with his original registration date — December 7, 2009. The ruling has already entered into force.
