A court in the Akmola Region has sentenced a woman accused of causing death by negligence. The tragedy occurred after the mother fell asleep while breastfeeding, and the child died of suffocation, reports infohub.kz.
According to the official Telegram channel of the courts of the Akmola Region, the Akkol District Court heard a criminal case against the defendant under Article 104, Part 1 of the Criminal Code (causing death by negligence).
The court found that the woman, while at home in a state of alcohol intoxication after drinking alcoholic beverages at a guest's home, fell asleep at night while breastfeeding the child. Upon waking, she discovered that the child showed no signs of life. The ambulance called to the scene pronounced the child dead from suffocation.
The case came to court with a procedural agreement in the form of a plea bargain. The prosecutor requested that the defendant be sentenced to restriction of liberty. The sanction of Article 104, Part 1 of the Criminal Code provides for punishment in the form of restriction of liberty for up to 3 years or imprisonment for the same term. In imposing the sentence, the court considered sincere remorse as a mitigating circumstance and the commission of the crime while intoxicated as an aggravating circumstance.
The court sentenced her to 1 year and 6 months of restriction of liberty with probation supervision. The court's verdict has not entered into legal force.
