Kazakhstan's Constitutional Court Bars Prolonged Detention Beyond Legal Limits

Kazakhstan's Constitutional Court has declared certain provisions within the country's criminal procedure law unconstitutional, specifically those allowing for detention beyond legally defined limits. This landmark decision is a significant step towards safeguarding citizens' fundamental right to personal freedom.

Citizen Appeals Prompt Review

The Constitutional Court's intervention came after citizens approached the court seeking a review of articles in the Criminal Procedure Code. These articles govern the grounds and procedures for detaining individuals. A key concern raised was the potential for extending detention periods even after a six-month period, calculated from the day a case enters court proceedings, had elapsed.

Another point of contention involved the possibility of altering a pre-trial detention measure to house arrest after a twelve-month period, and subsequently, the ability to revert this measure back to detention.

Court Upholds Individual Liberty

Emphasizing the guarantee of personal freedom enshrined in the Constitution, the Constitutional Court stated that arrest and detention are permissible only under conditions explicitly outlined by law. This implies that legislation must not only define the grounds for such restrictions but also establish the maximum permissible duration.

The Court concluded that holding an individual in custody beyond the period prescribed by law infringes upon this constitutional right and violates the principle of legal certainty. Specifically, the Court found the phrase "after the expiry of the period specified in the second part of the same article" in Article 342, Part 3 of the Criminal Procedure Code to be inconsistent with the Constitution.

Implications and Government Action

Furthermore, the Court clarified that the Criminal Procedure Code does not permit the re-imposition of detention after the maximum twelve-month period has passed. Following the Constitutional Court's ruling, the government has been tasked with initiating legislative changes within six months to align Kazakhstan's criminal procedure laws with the Court's decision.

This ruling reinforces the principle that liberty should not be curtailed indefinitely and ensures greater clarity and protection within the legal framework governing detention in Kazakhstan.
