Olga Abdygapparova Sentenced in Esentai City Construction Case
In Almaty, a court has delivered a verdict concerning Olga Abdygapparova in the case related to the construction of the "Esentai City" residential complex. Abdygapparova was found guilty on a single charge, resulting in a restriction of her liberty.
Guilty on One Charge
The Medeu District Court No. 2 in Almaty announced the verdict for Olga Abdygapparova. She was convicted solely on one count: Article 195, Part 4, Clause 2 of the Criminal Code of the Republic of Kazakhstan, which pertains to causing significant property damage through fraud or abuse of trust.
Sentence Details
The court sentenced Abdygapparova to two and a half years of restricted liberty under probationary supervision. Additionally, she is prohibited from holding leadership positions for a period of three years.
Her time spent under house arrest from February 8, 2023, to February 23, 2024, was factored into her sentence, counted as two days for each day served.
Clarification on Charges
Presiding Judge Zhomart Mukhametzhan explained that Article 195 differs from Article 190 ("Fraud") as it focuses on causing property damage without elements of theft. Since no theft was established during the investigation, the court did not apply Article 190.
"As evidence that the defendant's actions were aimed at theft was not presented to the court, the court reclassifies the charge from Article 190 of the Criminal Code of the Republic of Kazakhstan to Article 195 – 'Causing significant property damage multiple times, using official position, without signs of fraud'," the judge clarified.
Other Allegations Dismissed
The court also noted that the prosecution's theory of a crime committed by a "pre-arranged group" was not substantiated during the investigation. The roles of other individuals were not clarified, and conclusions could not be based solely on assumptions.
Additional Charges Considered
Abdygapparova had initially faced charges under other articles of the Criminal Code of the Republic of Kazakhstan:
The court specifically addressed an episode related to Article 250. The investigation suggested this involved an "extraordinary meeting" and Abdygapparova's subsequent "self-appointment" to a leadership position within the company. However, the court found that at the time, she did not meet the criteria for this article, lacking the necessary authority and status to be held accountable for exceeding her powers.
Regarding Article 189, the court determined that the presented evidence was insufficient to convict Olga Abdygapparova of appropriation or embezzlement.
Sentencing Rationale
In determining the sentence, the court considered Abdygapparova's lack of prior convictions and the fact that she has a minor child, deeming a restriction of liberty as an appropriate measure.
Olga Abdygapparova took over management of "AV-Construction" LLP in 2023, after it came under the control of its former owners. Prior to this, from 2016 to 2022, the firm was controlled by the Kospaev group, who were convicted in 2025 for raiding and embezzling 4.6 billion tenge.
According to the investigation, as director, Abdygapparova allegedly engaged in transactions that resulted in the illegal use of "AV-Construction" assets and caused damage to the company. Evidence included a settlement agreement with her husband, which the prosecution argued allowed her to avoid repaying 418 million tenge. The issue of nine apartments being registered in her mother-in-law's name was also raised, with the investigation asserting these actions constituted the illegal withdrawal of company assets.
The defense argued that the company suffered actual damages during the period it was controlled by raiders and that Abdygapparova was not at fault. Lawyers also highlighted procedural violations during the investigation, including the absence of expert examinations and audits, restricted access to case materials, and other issues.
Previously, on July 28, 2025, Judge Zalina Makharadze had returned the case materials to the prosecutor for further investigation, citing "serious errors" in the investigation. The prosecution appealed this decision, but the city court later overturned it, sending the materials back to the first instance court for review.
The state prosecutor had requested an eight-year prison sentence for Abdygapparova, along with a 10-year ban from holding official positions. In her final statement, the defendant argued that the case was based on the investigation's interpretation rather than facts and requested acquittal.
In July 2022, a prior conviction occurred in the "Esentai City" case: Olga Abdygapparova's husband, Almas, was found guilty of embezzling property on a particularly large scale during the construction of the residential complex. He was sentenced to seven years in prison with a seven-year ban from holding leadership positions in financial organizations.
