A court in Aktau has ordered a surgeon to pay 3 million tenge in moral damages for a poorly performed plastic surgery, infohub.kz reports.

According to the official Telegram channel of the courts of Mangystau Region, Aktau Court No. 2 heard a civil case brought by a woman against a doctor who performs surgical activities under a state license issued by the Ministry of Health of the Republic of Kazakhstan. The plaintiff sought compensation for material damage and moral harm.

The court established that in June 2022, the defendant performed plastic surgery on the plaintiff to correct the shape of her face. However, after the surgery, the patient developed scars in the ear and face area, and the condition of her soft tissues and appearance deteriorated.

Despite initial treatment, the plaintiff's health did not improve. Due to the worsening condition, she was forced to seek help from other specialists.

In 2025, the woman underwent a repeat corrective surgery in Almaty. After that, she suffered damage to a branch of the facial nerve and deformation of soft tissues. As a result of these medical consequences, the patient experienced prolonged physical discomfort and severe psychological suffering.

The plaintiff filed a lawsuit seeking 20 million tenge in material damages caused by the poor-quality medical services, as well as 10 million tenge as compensation for moral harm.

After reviewing the case materials, the court denied the claim for material damages because the plaintiff did not provide documentary evidence of all expenses incurred for subsequent treatment.

However, the fact of harm to health and moral suffering resulting from the poor-quality medical services was confirmed by forensic expert conclusions.

Given the established circumstances, the court partially granted the claims and ordered the defendant to pay the plaintiff 3 million tenge in moral damages. The court decision has entered into legal force.
