In Aktobe, an employer will pay an employee more than 10 million tenge after a workplace accident that resulted in severe injuries, reports infohub.kz.
According to the official Telegram channel of the Aktobe regional courts, the Aktobe court considered a civil case brought by an employee against a limited liability partnership (LLP) seeking compensation for material damage and moral harm caused by an accident while performing work duties.
During the court proceedings, it was established that the accident occurred due to the employer's fault, as the employer failed to ensure safe working conditions and compliance with labor safety legislation. As a result, the employee sustained severe bodily injuries.
According to case materials and medical expert conclusions, the plaintiff was assigned disability group II, with a loss of professional capacity of 80 percent.
After evaluating the evidence, the court found the plaintiff's claims partially justified. In determining the amount of moral compensation, the court considered the nature and severity of the injuries, the duration of treatment, the establishment of disability, the degree of physical and moral suffering, as well as the significant limitation of the ability to work and the disruption of the previous lifestyle.
By court decision, the employer was ordered to pay the plaintiff 10 million tenge in moral compensation and 255,000 tenge in material damages, covering expenses for necessary medications and forced transportation costs related to treatment.
The court decision has not yet entered into legal force.
