A resident of Almaty has filed a lawsuit against a contractor who failed to complete her apartment renovation on time and with violations. The details of the case are reported by the website infohub.kz.
According to the press service of the courts of Zhambyl region, the court upheld the claim of citizen M. against an individual entrepreneur to terminate the construction contract and recover funds.
In October 2025, the parties signed a contract for renovation works in an apartment in Almaty. The cost of the renovation was 6.2 million tenge. The plaintiff paid the defendant 4.7 million tenge for the first three stages of work. However, the renovation was not completed in full, and the quality of the work and materials used did not meet the contract terms.
The apartment owner repeatedly demanded that the defects be fixed, but to no avail. According to the court, access to the apartment was then terminated, and the contractual relationship effectively ended.
The defendant did not admit the claim, arguing that part of the work was completed and that the renovation could not be finished due to lack of access to the apartment.
According to the expert examination, the cost of the actually completed work and materials amounted to 1.4 million tenge. The cost of dismantling the tiles in all rooms and completely replacing them was estimated at 760,000 tenge.
The court concluded that the contractor had significantly violated the contract, resulting in the plaintiff being deprived of what she expected when signing it.
The court decision terminated the contract. The defendant was ordered to pay the plaintiff 3.9 million tenge, notary and representation costs, as well as expert costs totaling 385,000 tenge.
