A court in Karaganda has ordered the at-fault driver in a road accident to pay 434,000 tenge in compensation for lost profits — the amount the owner of the damaged car lost while it was out of service, reports infohub.kz.
The road accident occurred in September 2025 through the respondent's fault. As noted by the Karaganda Regional Court, the culprit was brought to administrative responsibility under Part 1 of Article 610 of the Administrative Code of Kazakhstan. The crash damaged a 2022 Hyundai Accent owned by a limited liability partnership.
During the trial, it was established that the company had rented out the car at 14,000 tenge per day. Repairs took 31 days, so the vehicle generated no income during that period. The owner sought to recover the lost profits from the accident's culprit, but the respondent argued against the calculations.
The court found that the company had indeed incurred losses due to the accident, and the rental agreement confirmed the commercial use of the car. Citing Articles 9 and 350 of the Civil Code of Kazakhstan, the court granted the claim in full and ordered the culprit to pay 434,000 tenge. Later, the civil appellate panel reviewed the appeal and upheld the ruling unchanged.
