The Court of Cassation has reviewed the case of a police officer's murder that occurred in January last year during a conflict in an Almaty bar, reports infohub.kz.
In the Telegram channel of the Court of Cassation for Criminal Cases, it was reminded that the murder was committed on January 11, 2025, in the bar "Pinta" in Almaty. The convicted person R. was sitting at the same table with the victim N. and other individuals. After N. made a remark about R.'s behavior towards one of the female visitors, a conflict arose between them, which continued outside and escalated into a fight. During the fight, N. struck R. several times, after which R. took a knife and inflicted two blows on N., and the victim died from the injuries.
The examination of evidence and video recordings by the cassation instance confirmed that the conflict arose on the grounds of suddenly arising hostile relations, and not from hooligan motives. The initiator of the fight was the victim N., who used physical force against R. and continued to follow R. as he was leaving into the building. R.'s response was caused precisely by this specific conflict. In this regard, the cassation instance recognized as justified the decision of the appellate instance to exclude the qualifying feature "from hooligan motives" and to change the qualification of R.'s actions from paragraph 9) of part 2 of Article 99 of the Criminal Code to part 1 of Article 99 of the Criminal Code — as intentional causing of death to a person.
The Court of Cassation decided that the punishment imposed on R. by the regional court was lawfully reduced from 16 to 14 years of imprisonment.
It should be recalled that on January 11, 2025, it became known that in Almaty a police officer died after a knife wound, and a suspect in the attack was detained. It was noted that the police officer was off duty and outside working hours. Later, a video of the incident appeared on social media, showing one man leading another out of the establishment, and the latter suddenly turns around and strikes the opponent, who tried to jump back. Then another video was published showing the beginning of the conflict between the police officer and a visitor to the establishment.
