In Kazakhstan, a man who again used violence against his wife after reconciling with her may face criminal liability. Despite the fact that he also avoided punishment the second time, the prosecutor's office protested the court decision, reports infohub.kz.

The Prosecutor General's Office protested the court decision in a domestic violence case. The man caused his wife minor bodily harm, after which the parties reconciled, and he was released from criminal liability. However, shortly thereafter, he again raised his hand against his wife. And for the second time, the case was dismissed due to reconciliation of the parties.

"The prosecutor's office disagreed with this. Following a cassation protest, the court ruling was overturned, and the case was sent for a new trial to bring him to criminal responsibility," the statement said.

The Prosecutor General's Office emphasized that this case is not isolated. "The Prosecutor General's Office has protested three more court rulings where individuals previously released from criminal liability due to reconciliation again avoided it on the same grounds," the supervisory body added.

The prosecutor's office separately drew attention to legislative changes that have been in effect since 2024. "Since 2024, liability for domestic violence in Kazakhstan has been significantly tightened. Battery and intentional infliction of minor bodily harm have been transferred from the administrative to the criminal sphere," the Prosecutor General's Office explained.

Now, repeated release on the same grounds is not allowed. "Now the law does not allow avoiding responsibility again in the same way. The law must protect those who need protection. And the prosecutor's office will ensure its strict enforcement," the Prosecutor General's Office stressed.
