A severe workplace injury led not only to physical suffering for a Kostanay resident but also to an attempt by the employer to evade responsibility. The man lost several fingers on his left hand during his shift, but the company claimed he never worked for them. The case went to court, reports the website infohub.kz.
According to the victim, he had been working as a miller without a formal labor contract since February 2026. The accident occurred on March 30 of that year. After the injury, he filed a lawsuit demanding recognition of the employment relationship, compensation for moral harm, and lost earnings.
The employer categorically denied the hiring. However, after examining the case materials, the court reached a different conclusion. Key evidence included witness testimony, notarized messenger correspondence, bank transfers, mobile operator data on the plaintiff's geolocation during working hours, and information about the company's operations.
“The court’s decision established that the plaintiff worked as a miller from February 1 to March 31, 2026. Additionally, the company was ordered to pay 3 million tenge in moral damages. The claim for lost earnings was denied as premature. No workplace accident investigation was conducted in accordance with the law, and the required document to determine the degree of loss of professional ability is absent,” said the press service of the Kostanay City Court.
The court’s decision has not yet entered into force. Notably, a similar labor dispute was recently won by a Kazakh woman with over 20 years of experience.
