In Uralsk, a court has refused to allow police to send a schoolgirl to a special educational institution, finding that her truancy was caused by bullying from classmates, reports infohub.kz.

The specialized inter-district juvenile court of the West Kazakhstan region reviewed a lawsuit filed by local police. Law enforcement insisted on placing the girl in a school for children with deviant behavior, citing systematic absences from classes.

However, during the hearing, other circumstances came to light. As reported by the regional court, the schoolgirl said she skipped lessons because of bullying. Constant pressure at school negatively affected her emotional state, and she could not bring herself to attend classes. The prosecutor also supported these arguments.

The court reminded about the Law "On Prevention of Offenses," which obliges educational institutions to create a safe environment and provide psychological assistance to children who have faced bullying.

The judge concluded that truancy without investigating the true reasons is not a basis for sending a child to a special school, and rejected the police's lawsuit.

Additionally, the court issued a special ruling to the police department and the education department, pointing out insufficient prevention and ignoring the girl's complaints about bullying.

The decision has not yet entered into legal force.
