Lawyer Opposes Sentence Reduction for Bayzhanov in Nukenova Case

Kazakh lawyer Zhanna Urazbakhova has voiced strong opposition to reducing the sentence for Bakhytzhan Bayzhanov, who was convicted in the murder case of Saltanat Nukenova. Urazbakhova contends that Bayzhanov was aware of Nukenova's dire state and actively participated in concealing evidence of the crime.

Forensic Findings Underscore Timeline

During a cassation hearing in Astana, Urazbakhova drew the court's attention to a forensic medical examination conducted on January 3. The report indicated that Saltanat Nukenova had passed away at least six to eight hours before her body was examined. Given that the examination took place at 9:40 PM, the estimated time of death was around 1:00 PM.

Allegations of Evidence Tampering

The lawyer asserted that Bayzhanov engaged in actions aimed at destroying evidence during this critical period. He allegedly instructed restaurant staff to leave and ordered the deletion of video recordings. Furthermore, Bayzhanov was tasked with disposing of Saltanat Nukenova's phone by taking it to various locations across the city before returning it to her home.

Urazbakhova emphasized that Bayzhanov knew Nukenova was in a life-threatening condition when he arrived at the restaurant at 10:00 AM that morning.

Evidence of Awareness and Continued Compliance

According to case materials, Bayzhanov entered Nukenova's room with a blanket and brought her medication. These actions, Urazbakhova argued, demonstrate his knowledge that Saltanat Nukenova was either close to death or had already died. Despite this awareness, he continued to follow the instructions of the convicted Kuandyk Bishimbayev.

Urazbakhova criticized the defense's claim that Bayzhanov was a victim of his own obedience, stating that he had the opportunity to call an ambulance but instead chose to continue concealing evidence.

Conclusion on Sentence Review

Zhanna Urazbakhova concluded that there are no grounds to review the verdict, which has entered into legal force. Bakhytzhan Bayzhanov was sentenced to four years in prison for failing to report Saltanat Nukenova's death. In a separate ruling, Kuandyk Bishimbayev received a 24-year sentence for the murder and torture of his wife.
