Student Wins Court Battle Against Akim, Secures Education Grant

A determined student from the West Kazakhstan region has won a significant legal victory against a local Akim, securing a coveted education grant after a prolonged dispute over the application process.

The case stemmed from the failure to announce a competition for the allocation of state-funded study places, leaving the student, identified as B., unable to pursue her medical education on a grant basis. She was initially enrolled in paid studies.

The Road to the Courtroom

This is not the first time the student has faced obstacles. Previous attempts to secure a grant were met with unlawful refusals from university admission committees, a fact later confirmed by a separate court ruling.

During the recent court proceedings, it was revealed that a grant had been allocated for the "medicine" specialty for the 2025/2026 academic year. Despite the availability of a vacant spot, the relevant authorities failed to initiate the required competition.

Court's Findings and Decision

The press service of the West Kazakhstan Regional Court stated, "The court determined that the authorized body did not conduct the competition for the vacant grant within the legally established timeframe. This violated the rights of individuals aspiring to free education."

The student sought not only the announcement of a competition for the vacant spot but also the direct assignment of the grant to her and a modification of the selection rules to consider only first-year grades. However, the court upheld the principle that grants are awarded solely through a competitive process and rejected these specific demands.

Ultimately, the specialized inter-district administrative court of the West Kazakhstan region ruled that the competition for the vacant grant must be held. The court's decision aims to ensure equal access to higher education and adherence to the established legal procedures for grant allocation.

This ruling has not yet entered into legal force.
