A court in Aktobe has ordered an employer to pay 10 million tenge in compensation for moral damages to an employee who was severely injured and became disabled as a result of an industrial accident, reports infohub.kz.

During the trial, it was established that the incident occurred due to the employer's fault, who failed to ensure safe working conditions and did not comply with occupational safety legislation. As a result, the worker sustained serious bodily injuries.

According to case materials and medical expert conclusions, the plaintiff was assigned disability group II, and the degree of loss of professional ability to work was 80 percent.

The court, having assessed the evidence presented, found the plaintiff's claims partially justified. In determining the amount of compensation for moral damages, the nature and severity of the injuries, duration of treatment, establishment of disability, degree of physical and moral suffering, as well as significant limitation of ability to work and disruption of previous lifestyle were taken into account.

By court decision, the employer was ordered to pay the plaintiff 10 million tenge in moral damages, as well as 255 thousand tenge in material damages, including expenses for medications and transportation related to treatment.

The court decision has not yet entered into legal force.
