A court in Petropavlovsk has ordered an insurance company to pay more than 2 million tenge to a car owner following a traffic accident, reports infohub.kz.

According to the official Telegram channel of the courts of the North Kazakhstan region, the No. 2 court of Petropavlovsk considered a civil case filed by the vehicle owner against the insurance company. The plaintiff sought to invalidate the damage assessment and recover the insurance payout.

The lawsuit stemmed from a traffic accident for which the at-fault driver was held administratively liable. His civil liability was insured by the insurance company.

After the accident, the insurance company assessed repair costs at 674,413 tenge. Disagreeing, the owner hired an independent appraiser who estimated damage including depreciation at 2,325,106 tenge.

The owner then appealed to the insurance ombudsman, who set the payout at 873,748 tenge. Still unsatisfied, the plaintiff went to court.

During the trial, the court ordered an automotive examination. The expert report valued repair costs, including parts and materials with depreciation, at 1,829,499 tenge.

The court accepted the expert report as reliable, noting it was conducted by a qualified specialist following established procedures. The report confirmed the insurance company’s repair cost estimate was understated.

As a result, the court voided the insurance company’s calculation and ordered it to pay 1,829,499 tenge to the car owner. Additionally, the insurer was ordered to cover court costs, bringing the total awarded to 2,039,821 tenge.

The ruling was upheld by the civil appeals panel of the North Kazakhstan Regional Court and has entered into force.
