A woman in Kazakhstan tried to evict her father from a house she owns, but the case reached the cassation court, and the Supreme Court ruled in favor of the man, according to infohub.kz.
According to the Cassation Court, the woman sought to evict her father, arguing she is the property owner. The trial court upheld her claim, but the appellate court reversed the decision, noting that the respondent is the plaintiff's biological father, who has the right to use the dwelling on equal terms with the owner.
Furthermore, the court established that the man has legally resided in the house since September 2022, and the daughter raised no objection during that time. Eviction would violate his right to his only housing. The Civil Cassation Board agreed with the appellate ruling and left it unchanged. Thus, the father retained the right to live in his daughter's house despite her opposition.
