Ex-Police Officer Wins Pension Recalculation in Kokshetau

In Kokshetau, a court has ordered the police department to recalculate the pension of a former officer, crediting his service on a preferential basis, according to infohub.kz.

The Specialized Interdistrict Administrative Court (SMAS) of Akmola Region considered a lawsuit filed by a former police officer against the police department, seeking recognition of his service as preferential and recalculation of his pension. As reported on the official Telegram channel of the courts of Akmola Region, the plaintiff served in the internal affairs bodies of Kazakhstan from 2002 to 2022. At the time of his dismissal, his length of service in preferential terms amounted to 29.5 years.

From January 31, 2003, to January 9, 2007, the plaintiff served in the Tselinograd District Department of Internal Affairs (RDD) as a junior inspector-cynologist in the criminal investigation unit. The man applied to the police department for a recalculation of his length of service for this period but was refused. The department justified its decision by stating that the village of Koktal, where the building of the Tselinograd RDD was located, had been transferred to the administrative subordination of Astana by a decree of August 8, 2000, and Astana is not among areas with severe climatic conditions that grant the right to preferential calculation.

The court established that the Tselinograd district continued to exist within other rural districts that are classified as areas with severe climatic conditions. The department unreasonably refused to credit the specified period of service on a preferential basis for the following reasons:

- The change in administrative affiliation did not alter the area of service or the nature of the plaintiff's duties;

- The right of an officer to preferential calculation of length of service is determined not by the location of the administrative building, but by the conditions of service and the territory where duties are performed;

- The plaintiff served in the Tselinograd district, involving trips to rural settlements, solving crimes, and performing official tasks outside the police building;

- The plaintiff's service was carried out throughout the entire district, which was classified as an area with severe climatic conditions.

The court ruled in favor of the former officer, ordering that the period from January 31, 2003, to January 9, 2007, be calculated on a preferential basis at a rate of one year of service for one and a half years. The court decision has not yet entered into legal force.
