In the Zhambyl region, a man with a childhood disability, 34 years after his mother's death, went to court over the denial of survivor's benefits. The dispute was resolved peacefully through mediation, reports infohub.kz.

According to the official Telegram channel of the Zhambyl regional courts, the man, who has been disabled since childhood, filed a lawsuit against the Department of the Committee for Regulation and Control in the Sphere of Social Protection of the Population. The plaintiff's mother died in 1992 when he was a minor. He lived with her and was fully dependent on her. In 1994, he was officially assigned disability group III since childhood.

The plaintiff applied to the department for survivor's benefits but was refused. One of the reasons was the lack of documented evidence of his dependency on his mother at the time of her death, as well as the fact that his disability was officially established later.

Disagreeing with the refusal, the plaintiff went to court, stating that he was a minor and unable to support himself, and that his disability had been established since childhood.

As a result of conciliation procedures in court, the parties decided to settle the dispute amicably and concluded a mediation agreement. Under the terms of the agreement, the plaintiff undertook to reapply to the department for benefits. In turn, the department pledged to properly consider the application and make an optimal decision on it.

The agreement was approved by the court, and the plaintiff was refunded the paid state fee. The court ruling has entered into legal force.
