In Taraz, a court has annulled the rulings of a private bailiff regarding the collection of alimony arrears from a child's father, reports infohub.kz.

According to the official Telegram channel of the Zhambyl Regional Courts, the specialized inter-district administrative court considered a lawsuit filed by a woman against a private bailiff, seeking to declare unlawful the rulings related to the determination of alimony arrears.

Under the enforcement document, the father was required to pay alimony to the plaintiff for the maintenance of their minor child, amounting to one-fourth of his salary and other income. In December 2024, the bailiff calculated the alimony arrears for the period from 2021 to 2024 at 3.2 million tenge.

However, in August 2025, the plaintiff filed a statement with the bailiff, saying she forgave the debtor's debt. Based on this statement, the bailiff canceled the ruling on the arrears. Later, in April 2026, the bailiff recalculated the arrears, but for a shorter period and at 513,000 tenge.

Disagreeing with this, the plaintiff went to court. She explained that she had written the statement forgiving the debt under the influence of repeated persuasion by the debtor.

The court noted that the right to receive alimony belongs directly to the child, not to the parent. Therefore, a parent cannot independently waive the child's right to these funds.

Under the law, release from paying alimony arrears for minor children is possible only by a court decision. A private bailiff does not have such authority. The court also stated that the calculation of the arrears should have taken into account the amount of 3.2 million tenge.

As a result, the court fully satisfied the lawsuit, declaring both bailiff rulings unlawful and annulling them. The decision has not yet entered into legal force.
