Kazakhstan to Introduce Blacklist for Developers to Protect Homebuyers
Kazakhstan is set to implement new regulations that will effectively limit the sale of housing by introducing a 'blacklist' for construction developers. This initiative, currently in its draft stages, is expected to be enacted soon, aiming to bring greater accountability to the real estate sector.
New Rules for the Housing Market
Starting July 1, 2026, Kazakhstan plans to adopt the 'Model Rules for the Formation and Maintenance of the Register of Builders'. While the document is still under discussion, its core objective is to increase transparency in the housing market and bolster the protection of equity holders' rights.
A Four-Tiered Registry System
Under the proposed system, the developer registry will be divided into four categories. Inclusion in this registry will not only depend on a company's reputation but also on its ability to attract financing. Developers categorized in the third tier will be prohibited from accepting funds from equity holders until they are removed from the registry. Banks and other financial institutions will also consider this registry data when making decisions.
Developers will have the right to appeal decisions regarding their inclusion in the registry, either through pre-trial proceedings or court action. However, filing an appeal will not suspend the effect of the decision.
Industry experts anticipate that this registry will help cleanse the market and increase the responsibility of major players in the construction sector.
