The Zhambyl regional court heard an appeal in a case seeking debt and penalty recovery under a contract for the demolition of the former Evraziya cinema building. The judicial panel amended the first-instance ruling, placing liability solely on citizen Ye., reports the website infohub.kz.

According to case materials, the parties signed a contract to demolish the building for 40 million tenge. Later, Ye. personally wrote a promissory note confirming receipt of an additional 10.4 million tenge beyond the agreed amount and undertaking to return the money by a specified deadline.

The obligation was not fulfilled. Ye. then filed a counterclaim, seeking to have the promissory note declared invalid, claiming he had written it under deception. The court found the note was written voluntarily and that no evidence of fraud or coercion was presented.

Initially, the Zhambyl district court fully granted the claim and recovered the debt and penalty from both defendants, while dismissing the counterclaim. The defendants appealed. On appeal, the civil panel dismissed the claims against individual entrepreneur 'B'. The rest of the ruling was upheld: citizen Ye. must pay 10.4 million tenge in debt and state fees. The counterclaim was definitively rejected.
