Court Reclaims 150,000 Hectares Illegally Granted by Kōnaev Administration
A significant land dispute has concluded with a court ruling in favor of the state, reclaiming 150,000 hectares of land that was illegally granted by the Kōnaev administration. The land was initially intended for the construction of a residential and entertainment complex, including a zoo.
Irregularities Uncovered
An unscheduled inspection by the Almaty Region Department for the Management of Land Resources revealed that officials had violated land legislation. The allocated parcel did not align with the city's master plan, raising serious concerns about the legality of the transaction.
Administration Fails to Comply
Following the discovery of these violations, the Department issued a directive to the Kōnaev administration to rectify the situation. However, the local authorities reportedly failed to comply with the order. This non-compliance prompted the prosecutor's office to file a lawsuit with the Kōnaev City Court.
Court Orders Land Return
During the court proceedings, representatives from the Department for the Management of Land Resources participated as a third party, providing detailed explanations of the identified legal breaches. The court ultimately sided with the prosecution, fully supporting their claims.
As a result of the court's decision, the 150,000-hectare land parcel, designated for commercial purposes, has been returned to state ownership. This ruling underscores the importance of adhering to land use regulations and master planning in urban development.
This development follows previous reports that the Almaty Region's Department of Architecture and Urban Planning had spent approximately 4.9 billion tenge on developing a new master plan.
