Kazakhstan: Tax Bills Arrive for Cars Sold Decades Ago

Kazakhstani citizens who sold their vehicles but failed to officially transfer ownership to the new buyer are now facing unexpected tax bills and penalties. This situation highlights a critical oversight in vehicle sales that can lead to significant financial burdens, even for cars sold decades prior.

An Unexpected Bill

Most vehicle owners assume their tax obligations cease once a car is sold. However, if the vehicle's registration is not updated to reflect the new owner, tax liabilities continue to accrue for the original owner. In a striking example, one Kazakhstani individual received a vehicle tax bill of 107,000 tenge and nearly 118,000 tenge in fines for a Ford Granada sold back in 1996.

Why Did This Happen?

The issue arose because the car was sold via a power of attorney, but the buyer never formally registered the vehicle in their name. Consequently, the car remained officially registered under the seller's name since 2013. Tax authorities had reportedly sent 13 warning letters and issued six enforcement orders during this period, but the original owner apparently did not act on these notifications.

Legal Implications

While Article 65 of the Tax Code stipulates a three-year statute of limitations for tax claims, this generally applies to the calculation or correction of newly identified tax obligations. If tax authorities have previously issued notifications and attempted enforcement, the statute of limitations may not apply. In such cases, individuals may be liable for the entire accumulated debt.

It is crucial for all vehicle sellers in Kazakhstan to ensure that ownership is officially transferred to the new buyer. Failure to do so means that taxes will continue to be calculated for the person listed on the technical documentation. Furthermore, ignoring notifications regarding tax debt can lead to substantial penalties. All vehicle owners are reminded that taxes are due by April 1st.
