Kazakhstan Considers Reintroducing Blood Alcohol Limit for Impairment Checks
Kazakhstan is considering the reintroduction of a blood alcohol content (BAC) limit، measured in per mille، for medical examinations to determine alcohol impairment. This proposal stems from a new draft by the Ministry of Health aimed at improving the medical certification process.
Refining Impairment Detection
A key aspect of the proposed changes involves reinstating a per mille threshold for identifying alcohol intoxication. Previously، until the end of 2020، Kazakhstan utilized a regulation that included a per mille scale. This scale classified blood alcohol levels between 0.5 and 1.5 per mille as mild intoxication، with readings below 0.5 per mille considered not intoxicated.
Clarifying Levels of Intoxication
The regulation that came into effect in November 2020 removed this scale، thereby eliminating the concept of a "permissible per mille." Now، the ministry is suggesting its return. The new draft proposes setting 0.3 per mille as the indicator for detecting the use of psychoactive substances.
According to experts، the 0.3 per mille threshold has been established considering individual physiological differences، the technical specifications of medical examination equipment، and potential inaccuracies in breathalyzers. This measure is intended to prevent false positive results.
Asil Kidiraliyeva، an official representative of the Ministry of Health، stated that the degree of intoxication will still be determined through a comprehensive examination and a doctor's final conclusion. Breathalyzer readings will remain just one of the tools used in the assessment.
Currently، doctors already provide a conclusion of "not intoxicated" if a breathalyzer shows a reading below 0.3 per mille. However، this practice is set to be officially enshrined in regulations.
Further Proposed Changes
The draft also outlines clarifications to the procedure for conducting laboratory tests، aiming to enhance the objectivity of medical findings.
Asil Kidiraliyeva further noted that the majority of these changes are designed to specify the procedures for medical examinations related to the use of psychoactive substances.
She indicated that following all necessary approvals، the updated regulations could come into effect within a few months.
