Surrogate Mother Demands Payment After Chinese Clients Abandon Newborn
A surrogacy arrangement in Almaty has taken a dramatic turn، with a surrogate mother demanding payment after the intended parents، a Chinese couple، refused to take custody of their newborn son.
The 27-year-old surrogate، Kristina Gavrilyuk، agreed to carry a child for the couple for a fee of 7.5 million tenge. During her pregnancy، she received a monthly allowance of 200،000 tenge from the prospective parents.
Premature Birth and Abandonment
However، complications arose when Gavrilyuk went into labor prematurely at seven months. Her son was born earlier than expected. According to Gavrilyuk، the biological parents abandoned the child immediately after birth، informing her only four hours later. They later requested a DNA test to confirm paternity، which proved positive.
Following the confirmation of their biological link، the couple reportedly cut off contact with Gavrilyuk and informed her they were relinquishing their parental rights to the child.
Legal Ramifications and Official Response
Gavrilyuk refused to assume responsibility for the child، leading her to report the situation to the police. Information regarding the biological parents is limited، with their nationality confirmed as Chinese. The clinic involved declined to comment on the case.
Saltyan Azirbek، an official representative of the Almaty City Police Department، stated that no criminal or administrative offense was identified، and therefore، no criminal case would be initiated. The matter is now considered a civil dispute to be resolved in court.
Advice for the Surrogate Mother
Surrogacy is legal in Kazakhstan، granting surrogates rights to medical care، health protection، and compensation. Legal experts have advised Gavrilyuk to pursue legal action. Given the foreign nationality of the biological parents، contacting the Chinese Embassy and the Ministry of Foreign Affairs has also been recommended.
Lawyer Gabit Umyrbekov suggested that criminal charges could potentially be filed against the biological parents under the Criminal Code for endangering the child's life and health by abandoning him in a precarious situation.
The Child's Current Condition
The newborn infant is currently in a stable condition at a local facility، gaining weight and developing well. The state will now oversee the child's future care and well-being.
