Kazakhstan Woman Denied Salary Due to Incorrect Birth Date in ID
A court in Kazakhstan has ruled in favor of a woman who was unable to receive her full salary and make essential payments due to an error in her national identification number (IIN). The mistake، a miswritten birth date، led to significant administrative and financial complications.
An Error in the Identification Number
The woman's birth certificate and marriage certificate indicated she was born on May 13، 1991. However، her national ID card contained an error in the section of her IIN representing her birth date، showing '31' instead of '13'. This discrepancy violated the established rules for generating identification numbers in Kazakhstan.
Challenges with Salary and Tax Payments
The incorrect identification number created substantial problems when her employer implemented a new payroll system. The system could not process mandatory contributions، including pension fund contributions and taxes، due to the mismatch in her personal data. This effectively blocked her ability to receive her full salary.
Police Action Deemed Unlawful
When the woman approached the district police department to correct the error in her IIN، her request was initially denied. The court found that the police department did not issue a formal administrative act but instead documented their refusal in a memo، which contravened administrative procedural laws. The court determined that the actions of the Karatal District Police Department infringed upon the woman's rights and legal interests، declaring them unlawful.
As a result of the court's decision، the woman's request to amend her IIN was partially granted. The police were ordered to correct her birth date to the accurate May 13، 1991.
