Kazakhstan's Constitutional Court: Accusations of Nazarbayev's Undue Influence

Allegations have surfaced suggesting that Kazakhstan's former leader، Nursultan Nazarbayev، exerted significant influence over the Constitutional Court to serve his own interests during the legislative process. Former parliament members claim Nazarbayev actively shaped court decisions and influenced judicial appointments.

Court's Role Under Scrutiny

According to former deputies، Murat Baymakhanov، the then-Chairman of the Constitutional Court، made decisions under Nazarbayev's sway، leading to what they describe as demonstrably unjust rulings. It is alleged that more than half of the court's 11 members prioritized Nazarbayev's agenda.

Amalbek Tshanov، a former parliamentarian، stated، "Nazarbayev used the Constitutional Court exactly as he wished. He appointed the people he needed to the positions."

Murat Baymakhanov's Position

Murat Baymakhanov، a professor، was appointed Chairman of the Constitutional Court in 1993 by the Supreme Council، which was dissolved shortly after. Prior to this role، Baymakhanov was known as a scholar focused on academic work، reportedly without prior experience of political pressure.

Tshanov characterized Baymakhanov as a "very meek person، without his own opinion، who would go along with whatever was said." He suggested that Baymakhanov failed to assert independence within the court، ultimately aligning with Nazarbayev's directives even when they contradicted the Supreme Council's views.

Nazarbayev's Alleged Directives

Former deputy Gaziz Aldamzharov recalled Nazarbayev's persuasive communication style. He recounted Nazarbayev saying، "Gazizhan، as long as I am alive، if you help me، you will be by my side. My rise is your rise. Until I die، you will be like my own kin by my side. Just help me، get me good votes."
