Woman Declared Bankrupt After Taking Out 6.3 Million Tenge Loan for Wedding

In Pavlodar، a woman has been officially declared bankrupt by court order after she was unable to repay a loan exceeding 6.3 million tenge، which she had taken out to fund a wedding celebration. The regional court's civil division released details of the case.

According to court documents، the woman initially managed to make timely payments on the loan obtained in 2019. However، her financial situation deteriorated، leading to her defaulting on the debt. Her total outstanding debt reached 6،344،644 tenge.

Financial Standing and Responsibilities

The woman reportedly has no stable source of income and is the sole provider for her two underage children. Court officials noted that the loan amount exceeded the legally stipulated limit of 1600 monthly calculated indices، and her obligations to multiple creditors remained unfulfilled for over 12 months.

Court Decision and Reasoning

Initially، the first court instance had rejected the woman's bankruptcy petition. However، she appealed this decision. The appellate court reviewed the case، deeming the financial manager's conclusion unfounded. They also determined that the debt amount was not correctly calculated and that there was no evidence of deliberate unlawful actions by the debtor.

Considering that the woman's financial difficulties stemmed from objective reasons، the court acknowledged that unemployment alone could not be a basis for refusing the bankruptcy procedure. Consequently، the appellate court overturned the initial decision and issued a new ruling declaring the woman bankrupt. This decision has now entered into legal force.
