Kazakhstan Considers Fines Waiver Under New Administrative Amnesty

Kazakhstan is planning to introduce an administrative amnesty that could not only exempt some citizens from liability but also potentially waive their outstanding fines. This initiative was announced by Minister of Internal Affairs Yerzhan Sadenov during a government meeting.

Who Will Benefit from the Amnesty?

According to Minister Sadenov, the amnesty will be applied exclusively to individuals who have committed offenses that do not pose a threat to public or state security. This means the focus is on less severe violations.

Exclusions from the Amnesty

However, the Minister clarified that certain serious offenses will be excluded from this amnesty. These include crimes of a terrorist, extremist, or corrupt nature, as well as offenses against the sexual integrity of minors and acts of torture. Individuals who have already completed their sentences or are currently on the wanted list will also not be eligible.

Potential Fine Waivers

A significant aspect of the proposed administrative amnesty is the consideration of waiving fines. The government is looking into the possibility of fully or partially canceling unpaid fines for individuals. The specific categories of individuals, the amounts to be waived, and the procedure for this waiver will be detailed during the drafting of the relevant legislation.

Timeline and Implementation

Prime Minister Olzhas Bektenov has set a deadline for the preparation of the administrative amnesty. He instructed the Ministry of Internal Affairs and the Ministry of Justice, in conjunction with the Prosecutor General's Office, to submit detailed proposals on the implementation mechanism within two weeks. This marks the first time Kazakhstan is initiating an administrative amnesty.

Background of the Amnesty

The initiative was previously announced by President Kassym-Jomart Tokayev, who highlighted that the amnesty would cover offenses not endangering citizens or state security. He noted that following a criminal amnesty last year, the country can now extend similar relief for certain administrative violations. President Tokayev urged Parliament to pass the necessary law by the end of the current session, emphasizing that the new constitution signifies a new era for the nation and a redefinition of the relationship between the state and society.
