A resident of the Abai region in Kazakhstan encountered an unexpected hurdle when attempting to renew his driver's license online. While navigating the state services portal, he discovered a startling entry indicating he was registered with a psychiatric clinic – a fact he vehemently denies and had no prior knowledge of.

This bewildering discovery prompted the man to take legal action, filing a lawsuit against the local clinic and the regional health department. His primary demand was to have this erroneous record declared illegal and completely removed from the national registry of mental health patients.

Clinic Admits Error

During the court proceedings, representatives from the medical facility acknowledged that the information had been entered incorrectly. It was revealed that the man had been placed on the registry without a comprehensive medical examination and in violation of established procedures. The clinic's representative also stated that the man's medical records had been destroyed due to the expiration of their storage period, though no documentation to confirm this destruction was presented to the court.

Health Department's Response

The regional health department, in its response, indicated that for the data to be expunged, the man would need to undergo another examination by a medical-consultative commission.

Court Rules in Favor of Citizen

After reviewing the case materials, the Specialized Inter-district Administrative Court of the Abai region concluded that the man's inclusion in the registry was indeed unlawful. The court noted that the defendants failed to provide any evidence that the citizen had sought psychiatric help, undergone any medical examinations, or consented to receiving medical care. Consequently, the court ruled in favor of the driver, ordering both the clinic and the health department to remove his details from the national psychiatric registry.
