Authorities responded quickly to the public outcry. The Astana City Police Department announced the apprehension of the 19-year-old resident. An administrative protocol was filed against him under Article 434 of the Code of Administrative Offenses of the Republic of Kazakhstan، pertaining to 'Minor hooliganism'. The case was subsequently forwarded to the court.

Court Ruling and Sentencing

The Specialized Inter-District Court for Administrative Offenses found the citizen، identified as K.، guilty of minor hooliganism under Part 1 of Article 434. The court's press service stated that the individual's actions، using the Baiterek monument، demonstrated clear disrespect for society and violated accepted norms of conduct.

During the court hearing، the young man fully admitted his guilt and expressed remorse for his actions. Despite his youth and student status، the court imposed a penalty of 5 days of administrative arrest.

Article 434 of the Code of Administrative Offenses of the Republic of Kazakhstan on 'Minor hooliganism' stipulates penalties that can include a fine equivalent to 20 Monthly Calculation Indices (approximately 86،500 tenge in 2026)، 20-60 hours of community service، or administrative detention ranging from 5 to 15 days. Repeat offenses within a year can lead to stricter penalties، including detention for up to 15-30 days.
