Images circulated on social media showing a young man lying on the ground in front of the Baiterek، making a vulgar gesture. This act was widely condemned by internet users as a sign of disrespect towards the nation and its symbols، igniting considerable public anger.

Swift Police Action and Court Proceedings

Authorities responded quickly to the public outcry. The Astana City Police Department announced the apprehension of the 19-year-old resident. An administrative protocol was filed against him under Article 434 of the Code of Administrative Offenses of the Republic of Kazakhstan، pertaining to 'Minor hooliganism'. The case was subsequently forwarded to the court.

Court Ruling and Sentencing

The Specialized Inter-District Court for Administrative Offenses found the citizen، identified as K.، guilty of minor hooliganism under Part 1 of Article 434. The court's press service stated that the individual's actions، using the Baiterek monument، demonstrated clear disrespect for society and violated accepted norms of conduct.

During the court hearing، the young man fully admitted his guilt and expressed remorse for his actions. Despite his youth and student status، the court imposed a penalty of 5 days of administrative arrest.

Legal Framework and Penalties

The court acknowledged the offender's age (born in 2006) and student status but emphasized the negative societal impact of his behavior and his disrespect towards the public. The court's decision has not yet entered into legal force.

Article 434 of the Code of Administrative Offenses of the Republic of Kazakhstan on 'Minor hooliganism' stipulates penalties that can include a fine equivalent to 20 Monthly Calculation Indices (approximately 86،500 tenge in 2026)، 20-60 hours of community service، or administrative detention ranging from 5 to 15 days. Repeat offenses within a year can lead to stricter penalties، including detention for up to 15-30 days.
