Car Buyer's Payment Delayed: Dealership Faces Consumer Rights Complaint

A resident of the West Kazakhstan region found himself in a frustrating situation after selling his car through a dealership, only to face difficulties in receiving the payment. The agreed-upon funds were not transferred within the timeframe stipulated in the contract, forcing the seller to escalate the matter to consumer protection authorities.

Contractual Agreement and Payment Delay

The incident occurred on February 2nd when the man entered into an agreement with the car dealership to sell his vehicle to a third party. The contract outlined the car's value at 5,150,000 tenge, with the dealership retaining a commission of 350,000 tenge. The seller was supposed to receive the remaining 4,800,000 tenge within 10 working days after the car and all necessary documents were processed.

The vehicle was handed over to the buyer on the same day the agreement was signed. However, by February 13th, the seller had still not received the payment in his account.

Dealership's Evasive Tactics

When the seller inquired about the delay, dealership employees initially asked him to wait until February 16th. They later promised to transfer the money by the end of that day, but this commitment was also not met.

Frustrated by the lack of action, the man filed a complaint with the Department for Trade and Consumer Rights Protection for the West Kazakhstan region on the same day. Officials there assisted him in preparing a pre-trial claim. After dealership representatives refused to accept the claim directly, it was sent via Kazpost. That evening, the payment was finally transferred to the seller's bank card.

Breach of Contract and Consumer Rights

The dealership violated the terms of the contract by failing to make the payment on time. Furthermore, their refusal to accept the pre-trial claim constituted a breach of consumer rights. Reports indicate that the dealership's dismissive response of "go wherever you want" exacerbated the situation and intensified the dispute.

This incident highlights the importance of clear contractual terms and timely fulfillment of obligations in vehicle sales transactions, as well as the role of consumer protection agencies in resolving disputes.
