Orphaned Student Sues Father for Child Support in Taraz

In a poignant case highlighting familial responsibility, a school student in Taraz has taken her father to court to secure child support payments following the tragic deaths of her mother and brother. The legal action comes despite the father having previously renounced his parental rights.

A Difficult Upbringing

The situation unfolded after the student's mother and brother passed away in 2018. The young girl was then taken in by her grandmother, who has since borne all the financial responsibility for her upbringing and education. According to the student, her father had formally relinquished his parental rights to her and her sibling in 2008. He had also reportedly blocked her phone number and ignored her requests for financial assistance.

The Legal Battle for Support

Facing mounting financial challenges, the student initiated legal proceedings to claim alimony. Her father contested the claim, citing his existing financial obligations to four other children from a subsequent marriage and outstanding loan commitments. He requested a partial reduction in the support amount.

Court's Findings and Decision

However, the court investigation revealed that the father was capable of working and receiving income from multiple businesses. Notably, on the day the court decision was to be made, the father reportedly ceased his entrepreneurial activities and had only recently officially registered as the father of four children. The court viewed this as a deliberate attempt to artificially reduce his alimony obligations.

The Taraz City Court ruled that the father must pay 17 MCI (approximately 66,844 tenge) monthly in child support until his daughter completes her schooling. Although the father appealed this decision, the Zhambyl Regional Court upheld the original ruling, and the court's orders are now legally binding.

This case underscores the legal framework in place to ensure parental support for children, even in complex family circumstances.
