Teacher Ordered to Repay 886,000 Tenge Grant After Early Departure
A young teacher in Aktobe has been ordered by a court to repay funds received through a state education grant after leaving their designated teaching position prematurely. The ruling mandates the teacher to return 886,000 tenge to the state.
According to court documents, the teacher received an education grant valued at 1.7 million tenge in 2017. The terms of the grant program required the recipient to work in a rural school in the Martuk district of Aktobe region for a minimum of three years.
Early Departure and Relocation
However, the teacher only served approximately 18 months at the rural school, including a youth practice period, before resigning and relocating to the city of Aktobe. Subsequently, the teacher secured employment at a school-gymnasium within the city.
Demand for Repayment
The Financial Center, responsible for managing these grants, initiated legal proceedings to recover the 886,000 tenge spent on the teacher's education. They also sought an additional 448,600 tenge in penalties for the unfulfilled service period.
During the court proceedings, the teacher attempted to justify their departure by claiming a lack of available positions in their specialty (foreign languages) at the rural school, which necessitated their move to the city. However, the court found these arguments unsubstantiated.
Court's Decision
The court's press service stated, "The court determined that the defendant's arguments were not supported by adequate evidence and do not absolve them from fulfilling their contractual obligations."
Consequently, the court partially granted the Financial Center's claim, ordering the teacher to repay the 886,000 tenge used for their education. The claim for penalties was dismissed, with the court deeming that amount to be unjustified.
This court decision has not been appealed and has entered into legal force.
