Almaty Landowners Face Temporary Use Restrictions for Infrastructure Projects
Almaty city authorities have issued a decree establishing limited usage rights for private land plots in the Zhetysu district. This measure, a form of public easement, allows for temporary use of private land for essential infrastructure projects, specifically for the "KL-110 power supply facility" during its construction phase.
Understanding Public Easements
The decree, published in the official city newspaper, stems from a request by the Almaty Department of Energy and Water Supply. A KL-110 kV power supply facility refers to high-voltage cable lines used to deliver electricity from substations to industrial sites, cities, and infrastructure hubs.
Impact on Property Owners
According to Zhakyp Khairushev, managing director of the National Chamber of Entrepreneurs of Kazakhstan "Atameken," this decree does not involve land expropriation. Instead, it grants the right to temporarily use specific portions of private land for the construction of engineering networks. The land will be returned to its owners after the work is completed.
However, energy expert Marat Kalmenov advises landowners to prepare for potential consequences. These restrictions could lead to a decrease in the market value of the affected plots, potentially leading to disputes over compensation amounts. "The land is not being taken away, but the owner's rights are limited. Construction within the easement zone is prohibited or restricted. After the work is completed, the plot owner will have to provide access to services maintaining the engineering networks," Kalmenov warned.
