Kazakhstan Replaces Technical Passports with Cadastral Ones for Property
Kazakhstan is undergoing a significant shift in its property documentation, with the term "technical passport" being officially removed from legislation. This change introduces the "cadastral passport of a real estate object" as the new standard, a move aimed at further digitizing government services.
Understanding the Change
Recent online discussions and some media reports suggested that all property owners in Kazakhstan would be required to urgently update their technical passports. However, the Committee for Civil Acts Registration and the Committee for Organization of Registration of Rights to Immovable Property and Transactions with Them, under the Ministry of Justice, have clarified that this information is inaccurate.
The New Cadastral Passport
The "technical passport" is no longer a valid legal term. It has been replaced by the "cadastral passport of a real estate object." This new document not only details the technical and identification characteristics of a property but also incorporates information pertaining to the land plot itself.
When is a Cadastral Passport Needed?
A cadastral passport is required in specific situations, such as when a property is being registered for the first time, undergoing reconstruction, or if there are changes to its technical specifications. Importantly, owners do not need to re-register for a cadastral passport when ownership changes, as the existing document retains its legal validity due to its comprehensive technical and identification data.
Therefore, the widespread concern about the immediate need for all homeowners to update their documents is unfounded.
