The legal battle surrounding Atyrau resident Rano Nigmetova has reached the cassation court, as her defense team challenges a previous verdict they deem unfounded. The upcoming court session is set to scrutinize the legality and validity of earlier judicial decisions.

Key Arguments from the Defense

Attorneys Rustam Akhmediyarov and Nurzhan Sarssembayev, representing Nigmetova, have stated that the court hearing is scheduled for March 3 in Astana. They contend that the prior court rulings failed to present adequate evidence to prove their client's guilt. "It is our position that there is no evidence in this case to prove the guilt of the accused. We believe that a person has been convicted without their guilt being fully proven," the lawyers stated.

Background of the Case

Rano Nigmetova was previously sentenced to 6 years and 6 months for large-scale fraud. According to the investigation's version of events, between March and April 2024, Nigmetova, along with an acquaintance, convinced a contact to transfer over 33 million tenge through an investment program. However, the promised returns were not realized.

Court documents indicate that the women also ordered flowers worth several million tenge, which they did not pay for. They then used these bouquets, presenting them as gifts on Instagram, to enhance their audience's trust and create content. This tactic was part of the alleged fraudulent scheme.

Appeals and Cassation Review

The defense team also argued that the appellate court, during its review, did not adequately assess the arguments presented by the defense or the conclusions reached by the first-instance court. The cassation review will focus on examining the legality and substantiation of the previously issued court decisions. Following the court session, the decisions may be upheld or subject to further review.

This development highlights the ongoing legal scrutiny of the case, with the defense aiming to overturn the existing conviction based on their claims of insufficient evidence.
