Woman Awarded 250,000 Tenge After Finding Pests in Candy

A resident of Kostanay has been awarded 250,000 tenge in moral damages after discovering pests inside a pack of candies purchased from a local supermarket. The court's decision highlights consumer protection rights in Kazakhstan.

The incident occurred last autumn when the woman bought sweets from a supermarket in Kostanay. Upon opening the package, she was shocked to find live insects, which were later confirmed by specialists to be parasites that had contaminated the product.

Seeking Compensation

The consumer filed a lawsuit seeking 2 million tenge in compensation for the emotional distress, disgust, and guilt she felt, particularly concerning her children, due to the purchase of substandard goods.

Supermarket's Response and Court Ruling

The supermarket acknowledged selling a defective product but contested the amount of compensation, arguing there was no evidence of health damage. They offered to pay 200,000 tenge voluntarily.

Considering that no actual harm to health was reported and taking into account the voluntary payments offered, the court reduced the compensation amount from the requested 2 million tenge to 250,000 tenge. The court's decision has not yet entered into legal force.

This case underscores the importance of product quality and consumer rights. It serves as a reminder to businesses about their responsibility to provide safe and high-quality goods to the public.
