The case was heard at Aktobe's Court No. 3, where the plaintiff sought damages for both material losses and moral suffering. According to court documents, the defendant, identified as O., failed to adhere to essential technical safety measures. This negligence directly led to the plaintiff, A., sustaining injuries that required hospitalization and multiple surgeries.

As a consequence of the accident, A. was classified as a Group 2 invalid. The court determined that the defendant's actions were the direct cause of the plaintiff's material expenses and emotional distress. Ultimately, the court ordered the defendant to pay 2,270,098 tenge for material damages and 10,000,000 tenge for moral damages.
