Ex-Police Chief Convicted of Rape Fights to Keep Official Apartment
A former head of police in Taldykorgan, Marat Kushybayev, who was convicted of rape and sentenced to 11 years in prison, has filed a lawsuit against the Zhetysu Regional Police Department. The dispute centers on the official apartment where his family currently resides.
Family Faces Eviction from Official Residence
Marat Kushybayev, the former chief of the Taldykorgan police department, who was sentenced for rape, has initiated legal proceedings against the Zhetysu Regional Police Department through his representative from prison. The core of the legal conflict is an apartment in the "Bolashak" microdistrict, which Kushybayev's family has occupied since 2016.
According to case documents, Kushybayev's wife and three children are currently living in the apartment.
Timeline of the "Housing-In-Need" Police Chief's Situation
In November 2016, local executive authorities allocated an apartment from the communal housing stock to Marat Kushybayev and his family, recognizing them as being in need of housing.
Shortly after, Kushybayev was dismissed from his position for "disciplinary misconduct unbecoming of a civil servant." In November 2023, he was detained on suspicion of raping a woman in his office. Subsequently, in April 2024, a court sentenced him to 11 years of imprisonment.
Arguments Presented in Court
During the court proceedings, Kushybayev's representative highlighted his over 35 years of service in law enforcement. The representative argued that his dismissal for misconduct should not serve as grounds for denying the privatization of the apartment.
Furthermore, the lawsuit stated that the family had undertaken significant renovations in the apartment.
"Given that the disputed apartment was provided to the defendant by the local executive body in 2016, it cannot be considered departmental housing and is subject to privatization. Dismissal from law enforcement for misconduct does not constitute grounds for refusing privatization; such a situation is not provided for in housing legislation," the case materials read.
Conversely, the Zhetysu Regional Police Department maintains that the apartment is official housing and that Kushybayev is no longer an employee. The department asserts that this housing should be returned to the pool of residences for active-duty officers.
"Since the convicted individual is currently not an employee of the department, we do not rule out that the claim will not be satisfied. A significant number of department employees are in need of housing," stated a representative of the Police Department in court.
Representatives from the housing relations and akimat departments of Taldykorgan city informed the court that they would leave the decision in the case to the court's discretion. Additionally, according to data from the unified system for accounting for queues "Kezekte.kz," Kushybayev was not registered as being in need of housing.
Court Sides with Former Officer
The Specialized Inter-district Administrative Court of the Zhetysu Region ruled in favor of the convicted police officer. The court acknowledged that the Police Department unlawfully failed to act on Kushybayev's request dated August 25, 2023, for over two years.
"To recognize the inaction of the Zhetysu Regional Police Department regarding the review of Marat Alimkulovich Kushybayev's report dated August 25, 2023, on the privatization of housing as unlawful. To oblige the Police Department to review the report at the housing commission," the court's decision stated.
However, the court refrained from assessing the merits of the issue.
"The court does not delve into the arguments of the parties regarding the legality or illegality of privatization by a person dismissed from law enforcement for misconduct. Such conclusions are considered premature as they are not a decision of the housing commission," the court ruling dated November 28, 2025, indicated.
Attempt to Prevent Eviction Denied
Alongside the main dispute, Kushybayev's family—himself and his wife—attempted to obtain a court injunction to prohibit the Police Department from initiating eviction proceedings. However, in October 2025, the Specialized Inter-district Administrative Court of the Zhetysu Region dismissed this claim as unfounded.
The claimants appealed this decision, but on January 21, 2026, the appellate panel upheld the original ruling.
Background of Marat Kushybayev's Case
It is recalled that in November 2023, Taldykorgan Police Chief Marat Kushybayev was arrested on suspicion of raping a 27-year-old woman. The victim's lawyer later detailed the circumstances of the incident. According to the lawyer, on November 12, 2023, a woman from Taldykorgan was brought to the internal affairs department for disturbing public order. The woman, who was being interviewed in the investigator's office, was subsequently taken to the office of the head of the department.
In late April 2024, former police officer Kushybayev was found guilty of rape and sentenced to 11 years in prison. He was also stripped of his awards and the special rank of "Colonel of Police."
Attempted Bribery of the Rape Victim
However, the case did not end there. In February 2025, the Koksu District Court sentenced three individuals involved in Kushybayev's case—the rape victim, her boyfriend, and a former court secretary—to six years in prison each.
It was discovered that Kushybayev's wife offered the victim a bribe of 40 million tenge. After receiving the money, the victim refused to change her testimony in the case. The court secretary acted as an intermediary, and the victim's boyfriend was also implicated in this scheme. The wife of Kushybayev filed a complaint against the victim, accusing her of fraud. Investigators initiated criminal proceedings against all three under the article "Fraud on a large scale." The court satisfied the victim's civil claim and recovered monetary compensation from the defendants.
In March 2025, the Anti-Corruption Service (now the Anti-Corruption Service of the National Security Committee of the Republic of Kazakhstan) launched an investigation into a criminal case concerning the fact of bribery of the victim by Kushybayev's wife. The investigation is ongoing.
