Aktau Yacht Club Dispute: 70,000 Tenge Fee Sparks Outrage Among Boat Owners
A heated dispute has erupted between the "Breeze" yacht club in Aktau and owners of small vessels, centering on a new fee that charges 70,000 tenge for each operation of launching or retrieving a boat from the sea. This significant charge has angered boat owners, who deem the yacht club administration's actions unlawful.
Boat Owners' Grievances
Previously, boat owners paid 300,000 tenge per month for mooring their vessels at the marina. However, they later discovered that the water area around the marina was not included in the land documents for their plots. The situation has now escalated with the installation of a barrier and the introduction of fees for launching and retrieving boats.
The boat owners argue that since the area is leased, the law obligates them to allow public access to the water, meaning no obstacles should be placed in the way of accessing the sea. They consider these measures illegal and detrimental to the development of tourism.
Yacht Club's Response
Oleg Morozov, captain of the "Breeze" LLP, stated that the barrier was installed in accordance with an approved project. He clarified that while citizens are allowed entry, the law says nothing specific about boats. Morozov explained that the club operates as a small vessel parking base and is obligated to monitor who goes to sea and under what conditions.
He cited the state border law and special instructions for maintaining small vessel parking as the basis for these requirements. The club asserts its duty to check documents of both the boat and its owner, and the entrepreneur's registration if commercial activity is involved.
"Why should we allow free use of our territory? There are established prices, and if a contract is made, the person legally uses the services," Morozov added. He emphasized that passing the barrier is free for yacht club clients, and the fee applies only to those using the area for launching or retrieving a boat, not for general access.
Long-Standing Dispute
According to the captain, this conflict has been ongoing for over a year. Club representatives claim that in the previous season, some boat owners used the marina without authorization, entering and mooring their vessels without payment.
Morozov also addressed the issue of the land beneath the marina, noting that many marinas were built in a state of legal uncertainty before the status of the Caspian Sea's water area was regulated. He mentioned that the club initiated the process of formalizing the land under the marina after the issue was resolved in 2024 and the plot was entered into the cadastre in 2025. He also stressed that the coastal parking area is leased for 49 years.
However, yacht owners maintain that access to the water must be ensured and consider the fee for accessing the sea unjustified.
Investments and Legal Matters
The yacht club highlighted that they possess the necessary documentation. A representative stated that approximately 50 million tenge has been invested in the facility over several years for renovations, dredging, and infrastructure development.
The "Breeze" club claims that some boat owners refuse to pay mooring and usage fees, citing the previously unresolved issue of formalizing the land beneath the marina. The club views this stance as an attempt to evade payment and refers to such users as "supporters of free infrastructure use."
The dispute is expected to continue in the legal arena, with both sides intending to defend their legal positions in the appropriate instances. It was previously reported on June 20, 2025, that mooring spots at the "Breeze" yacht club in Aktau had been occupied. Captain Oleg Morozov of "Breeze" LLP later commented on the situation. Subsequently, the "Breeze" administration accused the police of inaction, and lawyer Aybek Suyindikov warned of criminal liability.
Additionally, the "Breeze" yacht club administration noted that they have been awaiting a decision from the akimat regarding applications for land plots since last year, suggesting a potential deliberate sabotage of their application review.
