Kazakhstan Expands Automatic Fines for Traffic and Other Violations
Starting March 12, Kazakhstan is set to introduce significant changes to its Code of Administrative Offenses. These amendments will expand the scope of violations that can be automatically detected and fined through video cameras and other technological means.
Broader Scope for Automatic Fines
Previously, automated systems primarily focused on traffic violations like speeding and running red lights. However, the new regulations empower these systems to issue fines for a wider array of administrative offenses that can be registered by technical devices. If a camera or recognition system can identify an individual through state databases, an immediate resolution can be issued.
Determining Responsibility for Violations
In cases involving vehicle-related offenses, the vehicle owner is typically held responsible. However, there are provisions for exemption. Owners can avoid fines by proving that someone else was driving the vehicle at the time of the offense or that the vehicle was stolen. The law also mandates the use of only certified, verified technical equipment that meets cybersecurity standards.
Types of Fines and Calculation
The amount of fines will be calculated based on the Monthly Calculation Index (MCI). For 2026, 1 MCI is set at 4,325 tenge. Specific fines are outlined for various offenses, which can be automatically recorded via cameras, recognition systems, and state databases.
Impact on City Surveillance
City surveillance systems, including the popular 'Sergek' complexes, will now be capable of identifying a broader range of violations. While recordings were previously used as evidence, the new framework allows for automatic fine issuance for daily administrative offenses. This signifies a shift towards digital infrastructure serving not just as a security tool but also as a mechanism for continuous monitoring.
International Precedents
Similar automated fine systems are already in operation in other countries. For instance, China utilizes facial recognition cameras to fine traffic offenders, while Singapore employs an extensive video surveillance network and patrol robots. Dubai also features intelligent radar and monitoring systems.
It is important to note that driving without mandatory insurance carries a fine of 10 MCI (43,250 tenge). Operating a vehicle without passing technical inspection will result in a fine of 5 MCI (21,625 tenge) for the first offense, escalating to 20 MCI (86,500 tenge) if repeated within a year.
