The Mangystau Regional Prosecutor's Office recently held a collegium meeting, chaired by Regional Prosecutor Serikkali Kushaliyev, to address critical issues concerning the protection of citizens' constitutional rights during pre-trial investigations.

Ensuring Legality in Pre-Trial Proceedings

The meeting brought together regional court chairpersons and heads of law enforcement agencies. The primary agenda item focused on ensuring adherence to the law during investigative actions that impact citizens' constitutional rights in the pre-trial phase.

It was noted that in 2025, courts received 3,697 requests for sanctioning procedural actions, with 88.2% of these being approved. For the current year, this approval rate stands at 84.6%.

Detention Measures and Investigative Actions

Particular attention was given to the application of pre-trial detention measures. The meeting highlighted instances where requests for detention were denied due to insufficient justification from investigative bodies.

Furthermore, the procedures for conducting searches and seizures were discussed. Despite a high percentage of approved requests, violations were identified, including formalism in the preparation of procedural documents and breaches of legal requirements.

On a positive note, there is an observable upward trend in the use of alternative, non-custodial measures. In 2026, all applications for house arrest were granted by the courts.

"Ensuring citizens' constitutional rights is not a formality; it is the foundation of the criminal process. Every instance of their violation must be assessed on principle and eliminated from practice," stated the Regional Prosecutor.

Concluding the meeting, a comprehensive set of measures was approved. These aim to enhance the quality of pre-trial investigations, strengthen inter-agency cooperation within the framework of the three-tier model of the criminal process, and prevent future violations.
