Woman Acquitted After Killing Attacker to Save Husband
In a dramatic turn of events, a woman in the Abai region of Kazakhstan has been acquitted after being convicted of causing grievous bodily harm that led to a death. The case, which initially saw her sentenced to six years in prison, was re-examined by the cassation court.
A Desperate Act of Defense
The incident occurred in July 2024 when an attacker assaulted the woman's husband. According to court documents, the assailant pinned the husband down, pressing his foot on his neck in an attempt to strangle him. In a desperate bid to save her husband, the woman struck the attacker on the head with a piece of wood, tragically resulting in his death.
Initial Conviction and Appeal
The first-instance court found the woman guilty of intentionally causing severe harm, which inadvertently led to the victim's death. She was sentenced to six years imprisonment and ordered to pay 3 million tenge in moral damages. An appellate court upheld this decision.
Cassation Court Reconsiders
The defense argued that the woman acted solely to protect her husband and that her actions should be viewed with leniency. While the cassation court acknowledged her intent to defend her spouse, it noted that she had exceeded the limits of necessary self-defense by striking the attacker with a heavy object.
Mitigating Circumstances Lead to Release
However, the court also took into account several mitigating factors. These included the woman's remorse, the presence of minor children, her status as a Group III disabled person, and the fact that the deceased had initiated the conflict. Consequently, the case was reclassified under a less severe charge, resulting in a one-year prison sentence. As the woman had already served this time, she was released from custody in the courtroom.
